Human rights attorney, Femi Falana, has asserted that the presidency does not possess the power to absolve anyone accused of a criminal act.
According to Naija News, Falana made this declaration in response to the presidency’s remarks exonerating the Chief of Staff to the President, Femi Gbajabiamila, from allegations of bribery.
Bayo Onanuga, the Special Adviser to the President on Information and Strategy, dismissed the claims as the actions of an individual who supposedly pretended to be the Director-General of a non-existent governmental body.
Nonetheless, in a discussion with Punch, Falana contended that the presidency lacks the legal power to clear anyone involved in the case and demanded an independent investigation into both the Chief of Staff, Femi Gbajabiamila, and the self-proclaimed Director-General of the Presidential Foreign Intervention Promotion Council/Presidential Economic Advisory Council, Prince Adeniyi Adeyemi.
He maintained that the executive branch was not constitutionally authorized to exonerate any parties concerned, emphasizing that the complete apparatus combating corruption should operate independently.
In a conversation with one of our reporters, he stated, “The presidency lacks the authority to vindicate anyone. It falls to the police and anti-corruption agencies to look into allegations of public corruption.
“The presidency can merely refer Femi Gbajabiamila, alongside the other person, to the ICPC, as allegations of fraud and corruption have been made.”
The prominent lawyer questioned the financial allocations associated with the alleged agency, asserting, “The government must clarify to Nigerians why an extraordinary amount of ₦24bn was allocated to a nonexistent agency and how that entity managed to have accounts with the Central Bank of Nigeria.”
He demanded clarification of how an imaginary organization supposedly obtained a CBN account and received budgetary allocations.
